INDIA: Natco gets a stay for Imatinib

Natco has got a stay from the Supreme Court against the Chennai High Courts’ order for the IPAB hearing of Novartis’ appeals [for Imatinib] without a technical member.

The Chennai High Court had earlier decided that the IPAB could hear an appeal without a technical member.

Natco had then declared that it would go to the Supreme Court to against this decision for the constitution of the Bench comprising its Chairman and Vice-Chairman to hear the appeals, without a technical member.

Looks like the Supreme Court agreed with our reasoning that you cannot decide a patent appeal without a technical member!
